I would rather a seller just  tell me.....too bad buddy, UPS damaged your part, you sent it back to me and I have your $ and I'm not going to respond to your e-mails. I can't believe some people. Long story, but as they say, LET THE BUYER BEWARE.

Man, this guy is a power seller on e-bay and told me over a month ago he was sending me a check for the $ I paid and nothing since. I have sent him countless e-mails just asking what has happened and even what the status of the UPS claim was......no response. My guess is that he didn't insure the part for enough, UPS isn't paying and therefore, he isn't paying me or better yet, he has the UPS money AND my money and he's too far away for me to do a thing about it. He's a member on here. In my younger years, I would have hopped on a plane to knock on a door.

The sad part of the whole story is that he finally said he would just wait out UPS and send me my $, then nothing. His ebay seller name lists his name and his wife's (gf), whatever. A friend thinks she got involved and told him not to pay until UPS pays him. I look at like this.......I'm his customer and he's UPS's  customer. The part was obviously damaged by UPS. The claim should be cut and dry and he should have had his money a long time ago. Although I filed a damage claim as well with UPS, they won't tell me anything since I wasn't the shipper.

Like an idiot, I'm still hoping he does the right thing. I honestly believe he had good intentions, he just had never had a shipping problem and doesn't know how to handle it the right way.

Member has not been on here since July 20th and has no items listed on e-bay at present. I'm the only one that's been popped. I'm not really sure what "Again" means.

I wasn't going to leave you hanging forever. I just wanted to give him a chance to rectify the situation after seeing this post because he would know it was him, but if you need to know, his member name is starr455 and his ebay name is lisa_n_brian. Here's how it went down.....He offered to sell me a Hooker roll bar at a set price of $200 which included shipping. I told him that the shipping would be high but he was fine with it. He came back and said that after he got it to UPS they told him it was going to be $145 shipping alone so he would only net $55. He wanted more to cover more of the shipping and we agreed to $75 more which would be a total of $275 netting him $130. The bar arrived and one of the down tubes, believe it or not was bent inward beyond repair. How UPS bent a roll bar is beside me, but they did. I sent him pictures of the bar immediately and he said he had never had a problem with UPS and that I was filing a claim and he would as well. Instead of inspecting the bar like they said the driver would do, they picked up the bar, and eventually sent it back to starr455, I guess after inspecting it. Starr455 said that he had been going round and round with UPS on the claim and was going to send me a check and wait out UPS. That was on July 5th. I since sent him e-mails on July 12th, July 20th, July 28th and August 13th with no reponse. That's where we stand. He has a great rating on ebay, but no items listed at this point. I'm willing to give him a favorable rating if he makes this right, but he's dropped off the face of the earth.

my .02 the bar was bent before he shipped it and ups said sorry about your bad luck, my .10 send him an email and simply say, "when am i getting my money" when no response take the next step. have you contacted ebay?

The transaction was completed on here, not ebay. He just wanted me to know he that he was a powerseller on ebay and didnt screw people. I sent him a cashiers check for the first $200, then after he wanted another $75 to cover part of the shipping, I sent via PayPal to speed up the process.

He claims he purchased insurance for $200. He probably has that $200, the $145 that cost to ship it AND my $275 by now, not to mention the roll bar.

I will contact paypal, thanks. I'm not even sure what a power seller is, he just said he was and since he had so many transactions and 100% rating, I figured he knew what he was talking about.

Well, I contacted Paypal and filed a claim through them as well. Lisa's name is on their Paypal account. We'll see what happens.

i have delt with brian a few time in person very nice guy ,i would bet he will make it right , i bought a rearend off of him that turned out to need rebuilt told me to keep the rear and refunded my money, took a little while but i got it back

That's what is so strange about this whole transaction. The communication between he and I was pretty good and coming to an agreement on the shipping and the price of the roll bar went fine......then after the bar was bent, and he said he was going to send me my money back, nothing for 6 weeks. I was so confident I was getting my money back, I had already talked to another person that had a roll bar for sale and told him for two weeks I was going to pick it up. He eventually sold it because he said he couldn't wait any longer on me to pay for it

Yes, just let me know if he still has it. Someone mentioned to me the other day that Greyhound shipping would have been cheaper and probably more reliable. I don't know if there is a Greyhound bus station around him but we do have one downtown Bham. That might be an option.

I kept it wrapped because Brian asked me to after he I told him it arrived bent, but you can still see how bad the kink was. It was at the very top of the loop in the corner and the tube was fully pinched together.

From experience... UPS can be a PITA to deal with on claims. Had a perfect 76 shaker busted on their behalf. From what I read above, your situation is going as expected.  UPS picks up part, they inspect and send back to SHIPPER (not receiver). UPS denies all wrong doing. Sender typ needs to fight and then refund money. The insurance parts is BS and wasted money unless UPS packages the item themselves. Usually comes back insufficient packaging which in your case is so. Pictures before and after shipping item help alot.  You should be on the phone w/ UPS and help expedite your claim. Find the claim number and harp at UPS. The seller is probably on strings w/ UPS.

It will take time if neither of you make noise.

UPS refuses to discuss the claim since I wasn't the shipper.

First time I have logged on here in a while. I don't enjoy this site near like I used to and all because of a transaction gone wrong....leaves a bad taste in your mouth. Still nothing from Starr455, no response, no $............not a peep.

dont see why you would feel different towards the site, granted it sounds like a really bad experience with another member but unless it was a mod or someone running the site, it was a raw deal you got screwed on between two people.

Was this guy even an active member or just popped up to sell some parts??

Has nothing to do with the site. This transaction was the icing on the cake in a number of bad experiences over the last 3 years in building this car. I haven't been taken for near the money some members have.....(see Flounder's BAB thread), but a paint job never completed as promised put me in the red a good bit then this. Enthusiasm only goes so far in building these cars, you lose your fire for a while. I'm going to put a cover on it for a while and start up again in a few months. Tired of throwing good money after bad.

Hey don't let it get to you!  We have all been there and it is tough sometimes!  Hey your tide kicked Michigan A-- like I told you they would! ;D  Anyway there is alot of goodwill that goes around on here so just keep your head up!  Maybe a break is a good thing!  On a different topic but some relation, I located a 300 gallon aquarium for a friend who had been looking for quite awhile.  He built a cinder block stand and topped it with 4x4s.  We moved it and put it up on there and it was sitting on a knot.  Well you can imagine the rest of the story!   Now this guy was at his wits end, he wanted to quit everything!  So I told him to sleep on it and sure enuf he setup his old tank again and the search continues!
What is even more encouraging is that he hadn't paid in full for the tank so still owed money on it?!  Well today I called him and he paid me some more so I could give it to the guy who owned the tank!  Now if that doesn't give you some hope and good feelings I don't know what does?!  Hold your Head up Bama and get back at it when you are ready!

I believe it has to do with the post count.

I am 52 & I am not a Sr. member either. 

Not that it makes any difference to me...

It is unfortunate that you have lost the "spark" for the (your) Trans Am.   I was in your shoes at one time.  In a way I still am.   

If you need time away, take it.  You know what is best for your position.  Come back to the "family" when your mind & body (and I hate to say it, wallet) is fresh.

I too am involved with a non shipping / no return / no communication with a list member.  It sux, but I hold no grudge to  this forum.  Its between me & the other guy.

Take care & stop in once in a while.

As most of you know ( since it was brought up in this thread) I'm involved with something that was misrepresented to me.As Stan said, it's not the sites fault. Also. as Stan said, walk away for awhile but drop in occasionally to keep in touch. If this guy is truely a good guy he will do the right thing. Don't stress over it. It seems a few people here know him and they are probably wondering why he is leaving you hanging too.

 Take a deep breath.............stay in touch.............This guy will probably do the right thing. Maybe the some of the other guys on this site that know that guy may ask him "What's going on with this"? It will come full circle.

Brian has a set of Fisher Tops that look like they will bring about the same price as the amount owed me. I would gladly take the tops and call it even.

this is absolutley amazin. im trashed on here. just lovely. Scott i DID mail you  apersonal check in the amount of 275.00 on july 6th as PROMISED. i never recieved an email from you. since that day. now you want my t tops as a payment? i am a stand up guy who ALWAYS makes right with any deal. even HOMER told you that. i could have made you wait out ups as i am still doing but no i mailed you a check to clear us up. why didnt you ever file the claim with paypal for the 75.00? oh thats right ... you got your check. you have my personal cell phone number as well as many other members on here have it as well. why not give me a call? would make plenty of sense instead of degrading me on this site. i have not been on the site in awhile since i really didnt need to. guess i need to check in more often to see if anyone else is trashing me. we made a deal. i shipped part. ups bent part. i filed claim.  i mailed check. done deal.  and also i wish you were younger and did come a knocking on my door like you were thinking of doing as you said on here. really would have resolved it alot sooner....

Brian, I kept waiting on your check and never received it. Check your checking account. The money is still there. Since I waited longer than 45 days for the money Paypal said I couldn't file a claim. That paypal $75 has not been deducted from your account either. I have sent numerous e-mails since July. I defended you as well on here not understanding why you said you would voluntarily send the money then not do it and drop off the map. Bottom line is I don't have any money for whatever the reason. NO money from paypal, no money from UPS, no $ from you. Since you are so persistent about the money being sent, you might want to double check who you sent it to. I'm just glad you finally responded. As for the tops, it got you to respond, and that's all I was looking for. Another member e-mailed you twice about this issue. Have you not received any of these? I've personal messaged you, sent to the same e-mail address as the one when we were communicating during the transaction and it took a message through e-bay? Can you not understand how I feel on my end? I can send you copies of all my e-mails. Are they being deleted by children beforeyou see them? I can send you a printout of ALL transactions through my paypal account as well for the year if you like. Your statement is fair but not accurate. I almost just gave up trying to get a response and let this go. Again, thanks for responding. I just noticed in your message, you said I had your cell phone number and why didnt I call? I looked on the UPS transaction and your e-mails hoping I could find a number. Where was it?  I would have been glad to call and discuss this. As far as UPS goes, the tag on the roll bar stayed on the roll bar, which I know had your number on it, but they picked it up and I didn't even think to write it down before they picked it up. I wished someone that had your number had given it to me or called you to give you a heads up on this before it got this far.

scott, well this sounds like a really screwed up deal. i stand behind every deal ive ever made and will ever make in the future. i want this resolved with absoultely no hard feelings on anyones part. i will check my bank today on the check and see if it was cashed. if not i will GLADLY send you another.
ive checked all emails from july till now and havent seen any from you or any other member from here sending me anything. maybe it went to my spam? which auto deletes after a few days. why it would go there i have no clue since we emailed almost daily for awhile. lets get this cleared up ASAP.

This has been going on since August. I don't think you are going to get anything back. It only takes a few minutes to check and see if the check had cleared stop payment and reissue a check. It also only takes a second to ignore what the problem is.

No, at this point I'm just having a little fun with the whole ordeal. I know the check's not coming. I got taken. Sucks, but nothing to do at this point but laugh about it.

Matter of fact, with everything that has happened this week across the country, if he would just drop $100 in the local Salvation Army bucket for Xmas, I would call it even. We had a shooting this morning at a local hospital here in Birmingham. Gunman was killed after he shot two employees and a police officer. People are nuts these days, enjoy life.

Man, sounds like you guys had this worked out. Bummer....I know what it's like to get jammed-I've been an ebay-er for some time and it does happen. On here and PY, I have had excellent results and service along with parts that were exactly described by the selling party.
